Please read these Terms & Conditions carefully before using the Skillrank platform. They govern your rights and responsibilities as a user and form a binding agreement between you and Skillrank.
1. Acceptance of terms
- By accessing or using Skillrank (the 'Platform'), you agree to be bound by these Terms & Conditions ('Terms'). If you do not agree, do not use the Platform.
- These Terms apply to all users — students, recruiters, company administrators, and college representatives. Additional terms may apply to specific features or paid plans and will be presented at the relevant point.
2. Eligibility
- You must be at least 16 years old to use Skillrank. By creating an account, you confirm that you meet this requirement.
- If you are using the Platform on behalf of a company or institution, you confirm that you have the authority to bind that organisation to these Terms.
3. Accounts
- You are responsible for maintaining the confidentiality of your login credentials. Do not share your password with anyone.
- You agree to provide accurate, current, and complete information during registration and to keep it updated.
- You are responsible for all activity that occurs under your account. Notify us immediately at info@smarted.pro if you suspect unauthorised access.
- We reserve the right to suspend or terminate accounts that violate these Terms, provide false information, or engage in abusive behaviour toward other users or staff.
4. Acceptable use
- You agree not to use the Platform to: impersonate another person or organisation; submit false or misleading information in assessments or profiles; scrape, copy, or redistribute Platform content without written permission; attempt to reverse-engineer, interfere with, or disrupt any part of the Platform; upload or transmit malicious code or harmful content.
- Assessment integrity is fundamental to what we offer. Any attempt to cheat, game, or artificially inflate your employability score — including using third-party assistance during a test — will result in immediate account suspension.
5. Assessments and scores
- Skillrank's Employability Test scores are provided for informational purposes. They reflect performance on our assessments and are not a guarantee of employment or academic admission.
- We reserve the right to revise scoring methodology, retire assessments, or update question banks to maintain accuracy and relevance. Historical scores remain on file but may be marked as taken under an older version.
6. Recruiter and company use
- Companies and recruiters access candidate profiles strictly for legitimate hiring purposes. Using candidate data for any other purpose — including profiling, marketing, or resale — is strictly prohibited and may result in legal action.
- Recruiters must not contact candidates in a harassing or discriminatory manner. We reserve the right to revoke platform access for companies that violate this.
7. Intellectual property
- All Platform content — including assessments, interfaces, branding, and copy — is owned by or licensed to Skillrank. You may not reproduce, redistribute, or create derivative works without our prior written consent.
- You retain ownership of any content you submit (e.g. your profile information). By submitting it, you grant Skillrank a non-exclusive, royalty-free licence to use it to operate and improve the Platform.
8. Limitation of liability
- The Platform is provided 'as is'. We do not guarantee uninterrupted access, error-free performance, or specific employment outcomes.
- To the fullest extent permitted by law, Skillrank shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the Platform — including loss of earnings, loss of data, or missed opportunities.
- Our total aggregate liability to you for any claim arising from use of the Platform shall not exceed the amount you have paid us in the six months preceding the claim.
9. Third-party services
- The Platform may contain links to or integrations with third-party services. We are not responsible for the content, privacy practices, or reliability of those services. Your use of them is governed by their own terms.
10. Termination
- You may delete your account at any time from your settings. Upon deletion, your profile will be removed from recruiter search results and your personal data will be deleted in accordance with our Privacy Policy.
- We may terminate or suspend your access at any time, with or without notice, for conduct that violates these Terms or that we reasonably believe harms the Platform or its users.
11. Changes to these terms
- We may update these Terms from time to time. We will notify you of material changes by email at least 14 days before they take effect. Continued use after that date constitutes acceptance of the revised Terms.
12. Governing law
- These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka.
